President signs decree on measures to improve management in transport, communications and high technologies field

On January 12, President of the Republic of Azerbaijan Ilham Aliyev signed a decree on some measures to improve the management in the field of transport, communications and high technologies.

 

 The decree states:

 

“Governed  by Clause 32 of Article 109 of the Constitution of the Republic of Azerbaijan and in order to improve the management in the field of transport, communications and high technologies and ensure the activities of the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan, I hereby decide:

 

1. To approve “Regulations on the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan” (attached).

 

2. To establish the State Maritime Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan on the basis of the State Maritime Administration of the Republic of Azerbaijan.

 

 3. To establish the State Civil Aviation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan on the basis of the State Administration of Civil Aviation of the Republic of Azerbaijan.

 

 4. To approve the “Structure of the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan” (attached).

 

5. To determine the maximum number of staffers of the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan up to 190 people, maximum number of staffers of the Office and regional branches of the State Moto Transport Service under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan- 145 people, including the maximum number of staffers of the Staff of the Service - 100 people,  maximum number of  staffers of the State Maritime Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan -  65 people,  maximum number of staffers of the State Civil Aviation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan -  48 people,  maximum number of staffers of the Electronic Security Service under the Ministry of  Transport, Communications and High Technologies of the Republic of Azerbaijan - 18 people,  maximum number of staffers of the State Fund for Development of Information Technologies under the Ministry of Transport, Communications and High Technologies of Azerbaijan Republic - 12 people.

 

6. To transfer the Maritime Safety Center and Transport and Technical Support Department subordinate to the State Maritime Administration of the Republic of Azerbaijan to the State Maritime Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan with status of legal person in public law.

 

7. To transfer the State Inspectorate for Civil Aviation Safety subordinate to the State Civil Aviation Administration of the Republic of Azerbaijan to the State Civil Aviation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan with status of legal person in public law.

 

8. To determine that the President of the Republic of Azerbaijan appoints and dismisses the directors of the State Maritime Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan and the State Civil Aviation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan.

 

9. To cancel the first part of Decree No.880  of the President of the Republic of Azerbaijan dated  June 10, 2003  “On Approval of the Regulations on the Ministry of Transport” (Collection of Legislative Acts of Azerbaijan Republic, 2003, No. 6, Article 286; 2006, No.11, Article 945; 2007, No.6, article 601, 2008, No.8, article 719, No.11, articles 969, 970, 2009, No.2, Article 64, No.12, Article 983; 2011, No.2, Article 85; 2014, No.10, Article 1186 , No.12, Article 1578;  2016, No.3, Article 468, No.4, Article 660; 2017, No.1, Article 59).

 

 10. To cancel the first, second and third parts of Decree No.185  of the President of the Republic of Azerbaijan dated June 19, 2014 “On Ensuring the Activities of the Ministry of Communications and High Technologies of the Republic of Azerbaijan” and on repealing Decree No.111 dated August 10, 2004  “On Approval of the Regulations on the Ministry of Communications and Information Technologies of the Republic of Azerbaijan” (Collection of Legislative Acts of Azerbaijan Republic, 2014, No.6, Article 635, 2016, No.6, Article 1057, No.8, Article 1384; 2017, No.5, Article 844).

11. The Cabinet of Ministers of the Republic of Azerbaijan shall:

 

11.1. Prepare within a period of three months and submit to the President of the Republic of Azerbaijan proposals on aligning the acts of the President of the Republic of Azerbaijan with this Decree;

 

11.2. Ensure within a period of three months and inform the President of the Republic of Azerbaijan  about  the aligning of regulatory  acts of the Cabinet of Ministers of the Republic of Azerbaijan with the above-mentioned Decree;

 

11.3. Approve within one month the list of subordinate organizations that are not included in its structure  with the approval of the President of the Republic of Azerbaijan on the basis of the proposals of the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan;

 

11.4. Approve within one month the statutes and structures of legal persons in public law provided for in paragraph 6 of this Decree with the approval of the  President of the Republic of Azerbaijan;

 

11.5. Prepare within one month  the draft regulations of the State Maritime Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan and the State Civil Aviation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan and  submit to the President of the Republic of Azerbaijan;

 

1.6. Exercise control over the alignment of regulatory acts of  central executive bodies  with the present Decree and inform the President of the Republic of Azerbaijan about its execution  within  a period of five months;

11.7. Ensure within two months  the transfer of property on the balance sheet of the State Maritime Administration of the Republic of Azerbaijan, the State Administration of Civil Aviation of the Republic of Azerbaijan and their subordinate units, respectively to the balance of the State Maritime Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan, State Civil Aviation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan and their subordinate units;

 

11.8. Take measures to allocate the  funds provided in the state budget for 2018  for the State Maritime Administration of the Republic of Azerbaijan and the State Administration of Civil Aviation of the Republic of Azerbaijan, respectively to the State Maritime Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan, the State Civil Aviation Agency under the Ministry  of Transport, Communications and High Technologies of the Republic of Azerbaijan:

 

11.9. Address other issues arising from the present Decree.

 

12. The Ministry of Justice of the Republic of Azerbaijan shall ensure the alignment of regulatory acts of central executive bodies with this Decree and inform the Cabinet of Ministers of the Republic of Azerbaijan.”
